LEGAL WARNING – PRIVACY POLICY

 

The STATE CORPORATION FOR CULTURAL ACTION ABROAD, S.A., complies with the requirements established by the Information Technology and Communications laws, to which end the following Legal Warning has been formulated.

 

The STATE CORPORATION FOR CULTURAL ACTION ABROAD, S.A., informs that one’s use of the Web portal ascribes to him/her the condition of User. In this regard, the User commits to using the Web portal in line with the present Legal Warning, the regulations and instructions of which he has been made aware, as well as in accordance with morality, generally accepted correct codes and public order. Should the user be in disagreement with any one of the conditions established herein, he should not use/access this Web portal.

 

 

GENERAL INFORMATION

SEACEX ’s Web page aims to facilitate citizens information related to its corporate activities and services.

 

 

INTELLECTUAL PROPERTY

 

All of the Content on this Web portal, including and unlimited to texts, audio, video, graphics, photographs, images, its design and the intellectual property rights that might correspond to said content, as well as all of the brands, commercial names and any other distinct sign are property of seacex or of their legitimate owners, thus reserving all rights of said content. This content remains protected by the Intellectual Property regulation, specifically by the Royal Decree Law 1/96, which approves the Adapted Text of the Intellectual Property Law, and by the Law of Trademarks 17/2001.

 

Any act of reproduction of this Content, be it partially or wholly, in any form or medium, be it mechanical, electronic, reprographic or any other, as well as any act of dissemination, public communication or distribution without previous written authorisation from SEACEX or its legitimate owners is prohibited. Accordingly, SEACEX shall not be responsible for any harm or damages that may be derived from the use of the Content by users, nor shall it be responsible for the infraction of any existing legal regulations on behalf of said users.

 

Along the same lines, seacex is not responsible for the opinions expressed in articles, quotes, news originating from other public communication media, nor any other type of third-party publications, and shall remain exonerated in the case of any related legal claims.

 

CONTENT

 

SEACEX reserves the right to, without previous notice, modify the Web portal as it deems necessary. It also has the power to change, delete or add both content and offered services as well as the form in which said elements appear to be presented and located..

 

The Web portal User commits to proper use of the services offered by SEACEX, avoiding their use to carry out illicit activates and actions that undermine good faith and legal order, and to not cause damage to SEACEX’s physical and logical systems, nor to those of its suppliers or third parties.

 

 

EXCLUSION OF GUARANTEES AND RESPONSIBILITY

 

1.- SERVICES CONTINUITY

Access to the Web portal requires third-party services and supplies, including transportation through telecommunications networks whose reliability, quality, continuity and functioning do not correspond to SEACEX.

For this reason, SEACEX does not guarantee the availability and continuity of the Web portal’s functioning, Services and/or Content, and does not assume any type of responsibility for the harm and damage of any nature that may be due to the lack of said availability or continuity.

 

2.- WEB PORTAL SECURITY

SEACEX shall adopt the appropriate security measures, although it will not guarantee the absolute invulnerability of the Web portal’s security systems and Services. Nor will it guarantee the security or inviolability of said data in its transmission through the network; the User should be aware that the security measures of Internet computing systems are not entirely reliable.

Thus, SEACEX shall be exempt from total responsibility for any type of harm or damage that may be due to the knowledge that unauthorised third parties may have of the class, conditions, characteristics and circumstances of the Web portal’s users, Services and/or Content.

 

SEACEX does not control or guarantee the absence of viruses or other elements in the Content that may produce alterations to the user’s computing system (hardware and software) or to the electronic documents and folders stored on his computing system. In all cases, the availability of adequate tools for the detection and disinfection of damaged computing programmes corresponds to the User.

SEACEX is exempt from responsibility for any type of harm or damage that may be due to the presence of viruses within its Content or any other damaging elements therein.

 

3.- USE BY THE USER

SEACEX does not control the manner in which users utilise the Web portal, Services and/or Content, to which end it does not guarantee that their use will be in accordance with the law and present general conditions. SEACEX shall be exempt from any responsibility whatsoever for any type of harm or damage that may be due to the use of the Web portal, its Services and Content on behalf of users.

 

The ultimate objective of the hyperlinks and connections that appear on this Web page is to inform the user of the existence of other sources of information with regards to Internet content that may broaden or complete the information offered on the Web portal. SEACEX shall not be held responsible for the results obtained through said hyperlinks.

 

Under no circumstance shall SEACEX assume any form of responsibility derived from the content it links to from its Web page, nor shall it guarantee the absence of viruses or other elements on said pages that might produce alterations or damages to the computing system (hardware and software), to the user’s documents or files, excluding any responsibility for any type of damage that the user may suffer therefrom.

 

DATA PROTECTION

 

With regard to the importance of users’ privacy and confidentiality of personal information, SEACEX commits to the following points:

 

1.- To adopt a policy of confidentiality and Data Protection, with the goal of protecting the privacy of the personal information obtained and transmitted through its Web, and in accordance with that established in the present regulation regarding the Protection of Personal Data (Organic Law 15/1999, of 13 December) and other developing norms.


All of the personal information freely and voluntarily introduced into SEACEX’s network by the user, as well as that required to be introduced, such as username and password, fall under the Confidentiality and Data Protection regulations.

 

2.- Visiting the Web site does not imply whatsoever the transmission of any of the user’s personal information or data about himself. Nevertheless, those users who provide personal data unequivocally consent to the incorporation of their information into computer files for which SEACEX shall be responsible and that must be inscribed in the General Register of Data Protection, along with the computerised treatment or otherwise of said data, which may be used by SEACEX in providing services solicited by the user and/or in disseminating information on said services and activities.

This entity shall treat the data in a confidential manner, cancelling, erasing and/or blocking the information should it result inexact, incomplete or become unnecessary or irrelevant for use, in accordance with that set forth by the legislation regarding data protection.

 

3.- All of the information provided by the user through the Web portal should be truthful. To this end, the User guarantees the authenticity of all of the data that he shares. In any case, the User shall be the only one held responsable for false or inexact declarations made and for the damages caused to SEACEX or to third parties due to the information provided.


4.- SEACEX commits to comply with its obligation to keep all personal data confidential and comply with its responsibility to store said data in accordance with that established by the Regulation for Security Measures for computer files that contain personal data, approved by Royal Decree 994/1999, of 11 July. In this sense, SEACEX has adopted the technical and organisational measures to achieve the legally required security levels of Personal Data protection, all of which has been done to prevent the loss, improper use, alteration, unauthorised access and theft of the Personal Data provided.


5.- SEACEX recognises that users have the rights to access, cancel, rectify and oppose their data, which may be exercised by accessing our domicile via written communication with subject “Data Protection” providing: Name and Surname(s), photocopy of D.N.I., national identification card or other accredited document, domicile for notifications, petition detailing the reasons for the request, date and signature.

However, the user must be aware that in reality, Internet security measures are not impregnable and, therefore, he is not safe from possible illegal and undue interferences, which would not be the responsibility of SEACEX, which has already acted with due diligence in accordance with data protection law.

 

6.-SEACEX shall not transmit confidential information to third parties unless it is to properly comply with the provision of petitioned services, and always only in those cases deemed necessary, or when said transmission has been required by a judicial or legal order, or to protect the rights, both property and other, of SEACEX.

APPLICABLE LEGISLATION

 

The present Legal Warning is governed by each and every one of the points set forth by Spanish Law, with the parties expressly renouncing any other jurisdiction that might correspond to them and submitting themselves to the Courts and Tribunals of Madrid.
